Welcome to Kristy Holdsworth: The Professional Survivor® ("we", "us", "our", the "Website" or the "Service").
These Terms and Conditions ("Terms") govern your purchase, booking and use of all services provided by Kristy Holdsworth: The Professional Survivor®, including but not limited to:

Online pre-recorded educational programmes and digital learning materials;

Live online educational sessions;

Bespoke training and workshops;
-
Consultancy services;
-
Speaking engagements;
-
Organisational memberships;
-
Educational resources and downloadable materials;

Any other services provided directly to individuals, employers, organisations or advocacy services (collectively referred to as the "Services").
Services may be delivered through our Website, the Wix platform, online, in person, or directly under a separate written agreement where applicable.
By purchasing, booking, commissioning or accessing any of our Services, you agree to be bound by these Terms.
If you do not agree with these Terms, you should not purchase, book or access our Services.
1. Educational Disclaimer
Educational Purposes Only: All Services are provided for educational, informational and psychoeducational purposes relating to domestic abuse, trauma, workplace awareness and professional development.
No Therapeutic Relationship: Participation in any of our Services does not establish a therapist-client relationship, supervisory relationship, counselling relationship or any other professional therapeutic relationship between you and Kristy Holdsworth.
Not Medical or Legal Advice: Our Services do not constitute psychotherapy, counselling, medical advice, legal advice, diagnosis, crisis intervention or any other regulated professional service. Participants remain responsible for seeking appropriate professional support where required.
Crisis Support: We do not provide crisis monitoring or emergency support.
If you are experiencing immediate danger, are concerned about your safety, or require urgent mental health support, please contact emergency services (999) or an appropriate crisis or domestic abuse support service immediately.
2. Intellectual Property and Limited Licence
Ownership: Unless otherwise stated, all materials produced by Kristy Holdsworth: The Professional Survivor®, including but not limited to:

presentations;

training materials;
-
worksheets;
-
downloadable resources;
-
digital products;
-
written content;
-
graphics;
-
branding;
-
the VAL Framework™;
-
course structure;
-
programme content;
-
website content;
remain the intellectual property of Kristy Holdsworth and are protected by copyright, trade mark and intellectual property law.
Personal Licence: Where an individual purchases an online programme, a single, non-transferable, revocable licence is granted for personal, non-commercial use only.
Organisational Use: Where Services are purchased by an employer or organisation, access and permitted use are limited to those individuals expressly covered within the agreed booking or licence. Materials may not be reproduced, shared externally or reused for other training without prior written permission.
Prohibited Use: You must not:

copy;
-
record;
-
reproduce;
-
distribute;
-
upload;
-
modify;
-
resell;
-
sublicense;
-
share login credentials;
-
use our intellectual property to create competing products or training.
Unauthorised use may result in immediate termination of access without refund and may lead to legal action.
3. Payments, Pricing and Delivery
Online Services: Payments for online programmes and digital products purchased through our Website are processed securely via Wix and its authorised payment providers (including Stripe, PayPal or any other payment methods offered at checkout).
Access to digital Services will normally be provided immediately following successful payment unless otherwise stated.
Direct and Bespoke Services: Fees for consultancy, workshops, organisational training, speaking engagements, memberships and bespoke educational services will be agreed in writing before the Services are delivered.
Payment may be made by bank transfer, secure payment link, invoice or any other payment method agreed in writing.
Invoices are payable within the timescale stated on the invoice unless otherwise agreed.
Where payment has not been received by the due date, we reserve the right to:

postpone or suspend delivery of the Services;
-
withhold access to materials or recordings; and/or
-
charge statutory interest and recovery costs where permitted under the Late Payment of Commercial Debts (Interest) Act 1998 in relation to business customers.
Any expenses, travel or accommodation costs associated with bespoke Services will be agreed in advance and confirmed in writing where applicable.
4. Cancellation and Refund Policy
Digital Products: Under the Consumer Contracts Regulations 2013, consumers purchasing digital content ordinarily benefit from a 14-day cancellation period.
By purchasing and immediately accessing any digital programme or downloadable content, you expressly request immediate performance and acknowledge that you lose your statutory right to cancel once access has begun.
Accordingly, all sales of digital programmes are final unless otherwise required under UK consumer law relating to faulty digital content.
Bespoke Services: Cancellation of Bespoke Services: Unless otherwise agreed in writing:
-
cancellations made more than 28 days before the scheduled delivery date will receive a full refund of any fees paid (excluding any non-refundable expenses already incurred);
-
cancellations made 14–28 days before delivery will incur a charge of 50% of the agreed fee;
-
cancellations made less than 14 days before delivery will be charged at 100% of the agreed fee.
Where possible, we will endeavour to rearrange the booking to a mutually convenient date. Any deposits paid are non-refundable.
